Why does the job exist?
This position will provide expert-level legal advice on contracts and other legal documents, correct level of redactions to documents that may be released to third parties, a variety of questions from the various divisions of the agency, and other duties as assigned by the Chief General Counsel.
The position directs, plans, and performs complex technical legal work as an attorney and is responsible for some of the most complex legal work in CYFD.
How does it get done?
- Advises senior management on the most complex and difficult legal and managements issues, as assigned by the Chief General Counsel or the Office of the Secretary;
- Consults with agency staff on the interpretation of court opinions and statutes, the application of rules and regulations, and related matters where the most serious legal issues are involved;
- Represents CYFD in administrative and judicial proceedings, including drafting or assisting CYFD offices and divisions in preparation of documents, witness and exhibit preparation, presentation of evidence, appeals, and meeting all applicable time limits;
- Reviews, edits, and approves complex contractual and other legal documents and instruments, including policies and procedures, Joint Power Agreements, Memorandums of Understanding, within the time requested by the program area or as directed by the General Counsel or the Office of the Secretary;
- Reviews documents to be released in response to Inspection of Public Records Act (IPRA) requests to ensure that redactions are made in accordance with the confidentiality provisions of the Children's Code and other applicable State and federal statutes, regulations and rules;
- Negotiates settlements, determines further appeal of contested cases, and makes recommendations to the Deputy General Counsel or the Chief General Counsel concerning final clearance.

- Experience with and knowledge of contract law;
- Litigation experience;
- Experience with IPRA requests.
Minimum Qualification
Juris Doctorate degree from an accredited school of law and six (6) years of experience in the practice of law. Must be licensed as an attorney by the Supreme Court of New Mexico or qualified to apply for limited practice license (Rules 15-301-1 and 15-301.

Employment Requirements
All Attorney classifications must be and remain licensed as an attorney, in good standing, by the Supreme Court of New Mexico, or licensed as an attorney and in good standing by the highest court of another state and eligible pursuant to the limited license provisions (See Rules 15-301.1 and 15-301.2 NMRA).
Must possess and maintain a Driver's License. Pre-employment background investigation is required and is conditional pending results.
Working Conditions
Work is performed in an office setting : late hours, weekends, on-call and callback work may be required. Will be exposed to regular periods of video display terminal and keyboard usage and stressful situations.
Travel is required. Possible exposure to irate clientele. Incumbent will work under stress and frequent time constraints.
